These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Zerosum ("Company," "we," "us," or "our"), concerning your access to and use of the Lurk Logic desktop application and website.
BY DOWNLOADING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT DOWNLOAD OR USE THE SOFTWARE.
2. SOFTWARE LICENSE (NO DRM)
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software on devices owned by you.
Delivery: The Software is delivered as a downloadable executable (`.exe`) without license keys or DRM.
Prohibited Uses: You may not decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software. You may not resell, redistribute, or sub-license the executable file.
3. STRICT NO REFUND POLICY
PLEASE READ CAREFULLY
Because Lurk Logic is a digital, DRM-free product that cannot be "returned" or deactivated once downloaded, ALL SALES ARE FINAL.
We do NOT offer refunds for:
Change of mind or "Buyer's Remorse."
Incompatibility with your operating system (Windows 10/11 is required).
Failure to obtain or maintain a Reddit account or Google API Key.
Bans or restrictions placed on your accounts by third-party platforms.
Quebec Residents: By completing your purchase, you expressly acknowledge that the contract is performed immediately upon download availability, and you waive any right to cancellation under the Consumer Protection Act.
4. THIRD-PARTY DEPENDENCIES ("BYO KEY")
The Software requires your own API credentials to function. You acknowledge that:
Google Gemini API: You are solely responsible for managing your Google API Key, paying any associated usage fees to Google, and complying with Google’s AI Principles.
Reddit Access: The Software accesses public data via Reddit. We are not affiliated with Reddit Inc.
Platform Risk: Zerosum is not liable if Google or Reddit revoke your access, ban your IP, or change their API structure in a way that affects the Software.
5. ACCEPTABLE USE & LIABILITY
Lurk Logic is a research tool. It is not a weapon for spam.
You are the Operator: You agree that you are solely responsible for the content you generate and the messages you send.
Prohibited Conduct: You agree NOT to use the Software to harass users, send unsolicited bulk messages (spam), or violate the Terms of Service of any platform.
Indemnification: You agree to indemnify and hold Zerosum harmless from any claims, damages, or legal fees arising from your use of the Software or your violation of third-party rights.
6. DATA PRIVACY
We operate on a "Local-First" basis. Your lead data lives on your machine.
No Cloud Storage: We do not store or process your scanned leads.
Data Loss: You are responsible for backing up your local data files (`config.json`). Zerosum is not liable for data loss due to hardware failure.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEROSUM SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR SPECIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR REDDIT ACCOUNTS). OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
8. GOVERNING LAW
These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of Montreal, Quebec.
